Oct 2006 my husband was in a high speed crash in a 2006 Impreza. A 90 MPH crash. Into a guardrail. Twice. Landing in a shed supported by a steel beam. The beam finally stopped the vehicle. My husband suffered a broken collar bone, severe whiplash, 4 herniated disks, and post concussive disorder (which means severe, irreparable short term memory loss). When Subaru was contacted about the damage to the vehicle-the frame was broken in 3 places-and the injuries he sustained, he was told by Bill Hendrickson, Senior Representative, that 'it is their opinion that the Supplemental Restraint System operated as designed', and 'please understand that airbag deployment is determined by many factors, which will vary accident to accident'.

The airbags never deployed-so they told us to sue the driver.

WOW!  90 MPH and still alive to talk about it. Most people never survive at speeds that high.  Amazing!

I'm confused.  Your husband hit a guardrail doing 90mph??  Did he hit it with the front of the car so that the airbags sensors could detect the impact?

Anyone driving 90mph and survive a horrific crash should count themselves lucky as they were not very responsible in the first place.

What would you expect from a 90mph crash?  I'm sure the speed limit was 75 or lower.  Airbags are there to supplement the safety of the car.  Airbags, set belts, are all there to help save your life.

I agree with everyone.  How can you travel at 90mph then be suprised with horrific injuries when you crash, regardless of the safety systems involved.

Why does this remind me of the hot coffee in the lap while driving then being suprised when it spills and burns your legs then going to sue the people who gave you the hot coffee?  

Common sense goes a long way.

That being said, I do hope that your husband recovers as much as possible from his injuries.  Working with pain patients myself, I understand how much it will affect you and your family.

Subaru is  very likely,totally in the clear because their safety systems are designed to work at legal speeds.

The airbags are not designed to deploy if the front sensor is not hit.

If one of the battery cables was ripped out of the battery before the sensor was engaged,you won't get the signal power to activate the bag.

I am greatly saddened that your husband is now permanently injured and will have to get rehabilitation and training to work in a job that does'nt require him to use the damaged parts of his body.

You should sue the hell out of the insurance company that insured the driver because you are now faced with hundereds of thousands of dollars of operations and rehabilitation for our husband.


You really have no choice now.

One last thing-

Whenever a driver is breaking the law,however it is-that action effectively strips away alot of protections the law gives him and often makes him responsible for whatever happens whether it was his fault or not.
